These Terms and Conditions (“Terms”) govern your use of the website located at innovativehomeconcepts.com (the “Site”) operated by Innovative Home Concepts, Inc. (“IHC,” “we,” “us,” or “our”), an Illinois corporation with its principal place of business at 4410 IL-176, Ste 1, Crystal Lake, IL 60014. By accessing or using the Site, requesting an estimate, or engaging IHC for any service, you (“you” or “Customer”) agree to these Terms.
1. About Innovative Home Concepts
IHC is a family-owned exterior home improvement contractor serving McHenry County, Illinois and surrounding areas since 2004. Our services include siding installation and replacement, window installation and replacement, roofing installation and replacement, gutter installation including GutterShutter, exterior door installation, skylight installation, and related exterior renovation services. Service scope and availability are determined on a per-project basis.
2. Estimates and Quotes
IHC provides free, no-obligation estimates for qualifying residential projects within our service area. The following terms apply to all estimates and quotes:
- All verbal estimates are non-binding and provided for general planning purposes only.
- Written estimates are valid for thirty (30) days from the date issued unless otherwise specified in writing.
- Pricing in any estimate is contingent upon site inspection, product availability, and conditions disclosed at the time of inspection. Hidden conditions discovered during the work (rot, structural damage, code-required upgrades) may result in change orders priced separately.
- An estimate does not constitute a contract. Work begins only after execution of a written service agreement signed by both you and an authorized IHC representative.
- IHC reserves the right to decline any project, including after an estimate has been provided.
3. Service Agreements
The terms governing any actual installation, renovation, or repair work performed by IHC are contained in the separate written service agreement entered into between IHC and the Customer for that specific project. That service agreement controls in the event of any conflict with these Terms and addresses:
- Detailed scope of work, materials, and finishes
- Payment schedule, deposit requirements, and acceptable payment methods
- Project timeline and substantial completion criteria
- Cancellation and refund terms
- Workmanship warranty terms and duration
- Manufacturer warranty pass-through and registration
- Insurance, lien, and indemnity provisions
4. Property Access and Inspection
By requesting an estimate, you grant IHC and its representatives permission to access the exterior of the property at the address you provide for the purpose of taking measurements, conducting inspections, photographing existing conditions, and assessing the project scope. Photographs taken during inspection may be used by IHC for internal estimating, project documentation, training, marketing materials, social media content, and case studies. If you do not consent to the use of property photographs for marketing purposes, you must notify IHC in writing before or during the inspection.
5. Manufacturer Warranties
IHC installs products from manufacturers including but not limited to James Hardie, Andersen Windows and Doors, LP SmartSide, CertainTeed, GutterShutter, ProVia, Albany Door Systems, Midway Window Products, CraneBoard, Mastic, Azek, and Versetta Stone. Manufacturer warranties for installed products are issued directly by the manufacturer to the property owner, subject to each manufacturer’s terms, conditions, and registration requirements. IHC is not the issuer or guarantor of manufacturer warranties. Specific warranty terms, durations, and coverage are documented in each product’s official warranty literature and in your written service agreement.
6. IHC Workmanship Warranty
IHC provides a workmanship warranty on installation labor for projects completed by IHC. The specific duration, scope, and exclusions of the workmanship warranty are detailed in your written service agreement for the relevant project. The workmanship warranty covers installation methods and does not cover damage from acts of nature, ordinary wear, lack of homeowner maintenance, modifications by other contractors, or pre-existing structural conditions not disclosed at the time of inspection.
7. Communications and Marketing Consent
By submitting a quote request, contact form, or any other inquiry through the Site, by providing your phone number to an IHC representative, or by engaging IHC for any service, you consent to receive communications from IHC including but not limited to: telephone calls, SMS text messages, emails, and direct mail relating to your project, scheduling, estimates, and related home improvement services. Standard message and data rates may apply for SMS communications.
You may opt out of marketing communications at any time by replying STOP to any SMS message, clicking unsubscribe in any marketing email, or contacting IHC directly at (815) 356-9020 or info@innovativehomeconcepts.com. Opt-out of marketing communications does not affect transactional communications related to active projects or service agreements.
8. Pricing and Payment
All pricing for actual work is established in your written service agreement. Published pricing ranges on the Site, in marketing materials, or in social media are general estimates and do not constitute an offer. Payment schedules, accepted payment methods, deposit requirements, and balance-due milestones are governed exclusively by your written service agreement. IHC does not guarantee that any pricing referenced on the Site is current or applicable to your specific project.
9. Cancellation
Cancellation rights and procedures for any signed service agreement are governed by the terms of that agreement and by applicable Illinois law, including the Home Repair and Remodeling Act (815 ILCS 513/) and the Federal Trade Commission’s Cooling-Off Rule (16 CFR Part 429) where applicable. Free estimates carry no cancellation obligation on either party.
10. Limitation of Liability
To the maximum extent permitted by applicable law, IHC’s total liability arising out of or related to your use of the Site or any estimate provided shall be limited to the amount you paid to IHC, if any, in the twelve (12) months preceding the claim. IHC is not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or business interruption, even if advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Intellectual Property
The Site and all content on it — including the IHC name, logo, branding, written content, photographs, videos, design, and software — are the property of Innovative Home Concepts, Inc. or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content on the Site without prior written permission from IHC, except for personal, non-commercial purposes such as obtaining a quote for your own property.
12. Customer Reviews and Testimonials
Testimonials and customer reviews displayed on the Site or in IHC marketing materials are real statements from actual customers, reproduced with permission or sourced from public review platforms such as Google Reviews. IHC employees are never featured as customer testimonials, regardless of whether they were customers prior to joining IHC. IHC does not edit the substance of customer reviews; we may, where indicated, lightly edit reviews for length or for the removal of personally identifying information such as street addresses.
13. Third-Party Links and Services
The Site may contain links to third-party websites, products, or services that are not owned or controlled by IHC. IHC has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. Your interactions with any third-party are between you and that third-party.
14. Modifications to These Terms
IHC may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Material changes will be communicated via a notice on the Site. Your continued use of the Site after any such update constitutes your acceptance of the revised Terms.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms, the Site, or any IHC service shall be resolved exclusively in the state or federal courts located in McHenry County, Illinois, and you consent to the personal jurisdiction of those courts.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
